These Terms and Conditions ("Terms") govern every booking, purchase, and use of the website libertytravel.al (the "Website") operated by Liberty Travel ("Liberty Travel," "we", "us", "our"), a travel agency established in the Republic of Albania. By making a booking, placing an order, or otherwise using the Website, the customer ("Customer", "you", "Traveler") accepts these Terms in full. If you do not agree with any part of these Terms, you must not proceed with a booking.

These Terms apply to the relationship between Liberty Travel and consumers (business-to-consumer, "B2C") purchasing travel services for personal, non-commercial use. Separate commercial terms apply to bookings made by travel trade partners, corporate clients, or other businesses and are not covered by this document.

2. Definitions

       "Package" or "Package Travel Service" means a combination of at least two different types of travel services (e.g., transport, accommodation, car rental, other tourist services) for the purpose of the same trip, sold or offered for sale by Liberty Travel at an all-inclusive or total price, where Liberty Travel acts as the organizer.

       "Linked/Single Travel Service" means a single travel service (e.g., a hotel booking, a flight, or a standalone tour) booked through the Website, where Liberty Travel acts as an intermediary/agent on behalf of the underlying Supplier.

       "Supplier" means the hotel, airline, cruise operator, car rental company, local tour operator, or other third party that actually provides the travel service booked.

       "Booking Confirmation" means the document or email issued by Liberty Travel confirming the details and price of the Customer's booking.

       "Main Traveller" means the person who makes the booking and who is responsible for payment and for the accuracy of the information provided for all persons named in the booking.

3. Two Capacities in Which Liberty Travel Acts

Liberty Travel offers two distinct types of services, and the applicable rights, obligations, and liability regime depend on which capacity applies to a given booking. The Booking Confirmation will indicate which regime applies.

3.1 Liberty Travel as Package Organizer

Where the Customer purchases a Package assembled and sold by Liberty Travel under its own brand (e.g., a fixed-itinerary holiday combining flight, hotel, and transfers sold as a single price), Liberty Travel acts as the organizer of that Package and is responsible for the proper performance of all travel services included in it, in accordance with Section 7 below.

3.2 Liberty Travel as Agent/Intermediary

Where the Customer books a single service (for example, a stand-alone hotel stay, a single tour/excursion, or a flight only) through the Website, Liberty Travel acts solely as an intermediary between the Customer and the Supplier. In this capacity, the contract for the service itself is concluded directly between the Customer and the Supplier, and the Supplier's own terms and conditions, fare rules, and cancellation policies apply in addition to these Terms, as further set out in Section 8.

4. Booking Process and Formation of Contract

A booking request submitted through the Website constitutes an offer by the Customer to purchase the selected travel service(s), subject to availability and confirmation by Liberty Travel or the relevant Supplier.

The contract between the Customer and Liberty Travel (for Packages) or between the Customer and the Supplier (for Linked/Single Travel Services intermediated by Liberty Travel) is formed only upon issuance of a Booking Confirmation and, where applicable, receipt of the required payment. Prices, availability, and offers displayed on the Website are not binding until confirmed in writing.

The main traveler is responsible for ensuring that all information provided (names as per travel documents, dates of birth, contact details, and special requirements) is accurate and matches official identification documents. Liberty Travel is not liable for consequences arising from inaccurate information supplied by the Customer, including denied boarding or entry.

The main traveler confirms that they are authorized to make the booking on behalf of all persons named in it and accept these Terms on their behalf.

5. Prices, Payment Terms and Additional Charges

All prices displayed on the Website are quoted in the currency (EURO) indicated at checkout and include the taxes, fees, and charges applicable at the time of booking, unless stated otherwise. Prices may exclude optional extras, local taxes payable directly to the Supplier (e.g., city/tourist tax, resort fees), and services not expressly included in the description.

Liberty Travel reserves the right to correct manifest pricing errors (e.g., technical or typographical errors resulting in an obviously incorrect price) at any time before a Booking Confirmation is issued. If such an error is discovered after confirmation, Liberty Travel will notify the Customer and offer the option to reconfirm the booking at the correct price or cancel with a full refund.

A deposit or full payment may be required at the time of booking, as indicated during checkout. The balance, where applicable, must be paid by the deadline stated in the Booking Confirmation. Failure to pay the balance by the due date may result in automatic cancellation of the booking and forfeiture of the deposit, in accordance with Section 10.

Prices for Packages may only be increased after the contract is concluded if expressly provided for in the booking confirmation and only to reflect increases in the price of fuel or other power sources, taxes or fees imposed by third parties, or exchange rates and only up to the limits permitted by applicable consumer protection legislation. The Customer will be notified of any such increase at least 20 days before the start of the Package and has the right to terminate the contract if the increase exceeds 8% of the total price, in accordance with Section 10.4.

6. Travel Documents, Visas, Health and Customs Requirements

It is the Customer's sole responsibility to hold a valid passport and/or identity document valid for the entire duration of travel (and typically for a minimum period beyond the return date, as required by the destination country), together with any visas, transit permits, or health/vaccination certificates required for the itinerary booked.

Liberty Travel may provide general, non-binding information on passport, visa, and health requirements as a courtesy, but this does not replace the Customer's own verification with the competent embassy, consulate, or official government source, as requirements can change without notice and vary by nationality.

Liberty Travel accepts no liability for denied boarding, denied entry, deportation, fines, or any other consequence resulting from the Customer's failure to hold the correct or valid travel documents, visas, or health certificates.

7. Package Travel Services (Liberty Travel as Organizer)

Where these Terms apply to a Package as defined in Section 3.1, the following provisions apply in addition to Sections 1-6 and 9-21:

7.1 Scope of Liability

Liberty Travel is responsible for the proper performance of all the travel services included in the Package contract, irrespective of whether those services are to be performed by Liberty Travel or by other travel service providers.

7.2 Lack of Conformity

If any of the travel services are not performed in accordance with the Package contract, Liberty Travel will remedy the lack of conformity within a reasonable period, unless this is impossible or disproportionately costly. Where a significant proportion of the services cannot be provided as agreed, Liberty Travel will offer suitable alternative arrangements, where possible, of equivalent or higher quality, at no additional cost or a price reduction where appropriate.

7.3 Assistance

Liberty Travel will provide appropriate assistance without undue delay to a Traveler in difficulty, in particular by providing information on health services, local authorities, and consular assistance and by helping the Traveler find alternative travel arrangements.

8. Linked/Single Travel Services (Liberty Travel as Agent)

Where these Terms apply to a Linked/Single Travel Service as defined in Section 3.2:

       The contract for the service itself is between the Customer and the Supplier; Liberty Travel's role is limited to arranging the booking on the Customer's behalf and communicating the Supplier's terms.

       The Supplier's own conditions of carriage, accommodation rules, fare rules, cancellation policy, and liability terms apply and take precedence over these Terms in the event of any conflict specifically relating to the performance of that service.

       Liberty Travel is responsible for the correct processing of the booking (e.g., accurately transmitting the Customer's requirements and payment to the Supplier) but is not responsible for the Supplier's performance, cancellation, delay, overbooking, or quality of service, except to the extent such issues are directly caused by Liberty Travel's own error or negligence.

       Liberty Travel will pass on to the Customer, on a best-efforts basis, any assistance reasonably required to pursue a claim against the relevant Supplier.

9. Changes to the Booking Requested by the Customer

Requests to change a confirmed booking (e.g., dates, names, room type, itinerary) are subject to availability and to any change fees charged by Liberty Travel and/or the Supplier. Some fare types, promotional rates, and non-refundable bookings do not permit changes at all, as indicated at the time of booking.

10. Cancellation by the Customer

10.1 General Rule

Unless a specific cancellation policy is stated for the booking at the time of purchase (which will prevail), the following general cancellation charges apply, calculated as a percentage of the total price, based on the number of days before the start of the trip that Liberty Travel receives written notice of cancellation:

       More than 45 days before departure: loss of any non-refundable deposit only.

       30-45 days before departure: 30% of the total price.

       15-29 days before departure: 50% of the total price.

       7-14 days before departure: 75% of the total price.

       Less than 7 days before departure, or no-show: 100% of the total price.

10.2 Non-Refundable and Promotional Rates

Certain rates, particularly discounted or promotional fares and non-refundable hotel rates, may be entirely non-refundable and non-changeable from the moment of booking, regardless of the general scale above. This will be clearly indicated before the Customer completes payment.

10.3 Cancellation Due to Force Majeure Affecting the Customer

Cancellation charges under Section 10.1 apply regardless of the reason for cancellation, unless the Customer holds valid travel insurance covering the relevant cause, in which case the claim should be directed to the insurer.

10.4 Customer's Right to Terminate Following a Price Increase or Material Change (Packages only)

Where Liberty Travel, acting as organizer of a Package, notifies the Customer of a price increase exceeding 8% of the total price or of a significant change to an essential term of the Package, the Customer may, within the period specified in the notification, either accept the change or terminate the contract without paying a termination fee and receive a full refund of all payments made.

11. Changes or Cancellation by Liberty Travel

Liberty Travel will make reasonable efforts to operate all bookings as confirmed. However, Liberty Travel (or, for Linked/Single Travel Services, the Supplier) reserves the right to make minor changes to a booking (e.g., minor schedule adjustments, equivalent accommodation substitutions) where necessary and will inform the Customer as soon as reasonably possible.

If Liberty Travel or the relevant Supplier must cancel or make a significant change to a confirmed Package for reasons other than the Customer's default, the Customer will be offered, where reasonably possible, a suitable substitute arrangement of equivalent or higher quality or a full refund of all payments made without undue delay.

Liberty Travel will not cancel a Package less than 20 days before departure on the grounds of insufficient participants, except where this threshold has been expressly disclosed to the Customer at the time of booking.

12. Liability and Limitation of Liability

Except as set out in Section 7 for Packages, Liberty Travel's liability towards the Customer is limited to losses that are a direct and foreseeable result of Liberty Travel's own breach of these Terms, negligence, or willful default in arranging the relevant booking.

Liberty Travel is not liable for (a) acts or omissions of the Customer or of third parties unconnected with the provision of the travel services; (b) unavoidable and extraordinary circumstances as defined in Section 13; (c) loss, damage, illness, injury, or death arising from activities not organized or supplied by Liberty Travel, including optional excursions purchased locally and not booked through the Website; or (d) indirect or consequential loss, including loss of enjoyment, loss of income, or loss of opportunity, except where mandatorily required by applicable consumer protection law.

Where international conventions apply to a particular travel service (e.g., the Montreal Convention for air carriage or the Athens Convention for sea carriage), Liberty Travel's and the relevant Supplier's liability is limited in accordance with those conventions.

Nothing in these Terms excludes or limits liability for death or personal injury caused by proven negligence, for fraud, or for any other liability that cannot lawfully be excluded or limited under the applicable law.

13. Unavoidable and Extraordinary Circumstances (Force Majeure)

Neither Liberty Travel nor any Supplier is liable for any failure to perform, or delay in performing, its obligations where this is caused by unavoidable and extraordinary circumstances beyond its reasonable control, including but not limited to natural disasters, adverse weather, war, terrorism, civil unrest, epidemic or pandemic, government travel restrictions or advisories, strikes, and airspace or airport closures. In such cases, the remedies available to the Customer are limited to those provided under Sections 10 and 11 and applicable law, and Liberty Travel is not liable for any additional compensation.

14. Travel Insurance

Liberty Travel strongly recommends that every traveler take out comprehensive travel insurance, covering at minimum trip cancellation, medical expenses and emergency repatriation, baggage loss, and personal liability appropriate to the destination and activities booked. The Customer is solely responsible for arranging adequate cover and for verifying the terms, exclusions, and claims procedure of any policy purchased.

15. Special Requests and Reduced Mobility

Special requests (e.g., dietary requirements, room preferences, accessibility needs) will be passed on to the relevant Supplier but cannot be guaranteed unless expressly confirmed in writing by Liberty Travel. Customers with reduced mobility or specific medical or accessibility needs must inform Liberty Travel in writing at the time of booking so that suitability can be verified with the relevant Supplier.

16. Complaints and Claims Procedure

Any lack of conformity noticed during the trip should be reported without undue delay to the relevant Supplier's local representative and to Liberty Travel so that a remedy can be attempted while the traveler is still at the destination.

Complaints not resolved on the spot must be submitted in writing to Liberty Travel within 14 days of the end of the trip, using the contact details published on the Website, together with supporting documentation. Liberty Travel will acknowledge receipt and respond within a reasonable period and, in any event, within the timeframe required by applicable consumer protection legislation.

If a complaint cannot be resolved directly with Liberty Travel, the Customer may refer the matter to the competent Albanian consumer protection authority or pursue the dispute resolution options described in Section 20.

17. Data Protection and Privacy

Liberty Travel processes personal data provided by the Customer (including names, contact details, payment information, and passport details where required by a Supplier) solely for the purposes of processing bookings, complying with legal obligations, and, where consented to, for marketing communications. Personal data may be shared with Suppliers, payment processors, and public authorities to the extent necessary to perform the booking (e.g., airlines, hotels, and border authorities).

Full details of how personal data is collected, used, stored, and protected and of the Customer's rights (including access, rectification, erasure, and objection to marketing) are set out in Liberty Travel's separate Privacy Policy, published on the Website, which forms part of these Terms by reference.

18. Intellectual Property

All content on the Website, including text, images, logos, itineraries, and design, is the property of Liberty Travel or its licensors and is protected by applicable intellectual property law. The Customer may not reproduce, distribute, or exploit any part of the Website's content for commercial purposes without Liberty Travel's prior written consent.

19. Website Use, Availability and Disclaimers

Liberty Travel takes reasonable care to ensure the accuracy of information published on the Website, including prices, availability, descriptions, and images, but does not guarantee that the Website will be uninterrupted, error-free, or free of viruses. Descriptions and images of destinations, hotels, and services are provided for guidance and may be supplied by Suppliers; minor variations between the description and the service actually delivered may occur and do not, of themselves, constitute a breach of contract.

Liberty Travel is not responsible for the content of external websites linked from the Website.

20. Governing Law and Dispute Resolution

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by the laws of the Republic of Albania, including Law No. 9902, dated 17.4.2008 "On Consumer Protection" (as amended) and the Albanian Civil Code.

Where a booking concerns travel to or within the European Union, Liberty Travel additionally has regard, as a matter of its own service standard, to the principles established under EU Directive (EU) 2015/2302 on package travel and linked travel arrangements. This reference is made voluntarily to inform Liberty Travel's practices and does not, of itself, make EU law directly binding within the Republic of Albania or alter the governing law and jurisdiction set out in this Section.

The Customer is encouraged to attempt to resolve any dispute amicably with Liberty Travel before pursuing formal proceedings. Subject to any mandatory consumer protection rules granting the Customer the right to bring proceedings in their own country of residence, the courts of Tirana, Albania, have exclusive jurisdiction over any dispute arising from these Terms.

21. Miscellaneous Provisions

21.1 Entire Agreement

These Terms, together with the Booking Confirmation, the Privacy Policy, and any Supplier-specific terms referred to at the time of booking, constitute the entire agreement between the Customer and Liberty Travel in relation to the booking.

21.2 Severability

If any provision of these Terms is held invalid or unenforceable by a competent authority, the remaining provisions will continue in full force and effect.

21.3 Amendments

Liberty Travel may update these Terms from time to time. The version in force at the time a booking is confirmed applies to that booking. The current version is always available on the Website.

21.4 Assignment

The Customer may not transfer their rights or obligations under a confirmed booking to a third party without Liberty Travel's prior written consent and, where applicable, the Supplier's consent and subject to any applicable transfer fee.

21.5 No Waiver

Failure by Liberty Travel to enforce any provision of these Terms does not constitute a waiver of that provision.
